Article 2. Purpose
The purpose of these general conditions of sale (hereinafter the “GCS”) is, on the one hand, to inform any person of the terms and conditions under which Anticipolis offers for sale and delivers to the Customer (such as as defined below) of the products ordered via the site and, on the other hand, to define the rights and obligations of the parties within the framework of the sale of Products on the Site.
The fact for any Customer of Ordering a Product offered for sale on the Site implies full and complete acceptance of these GCS, which the Customer explicitly acknowledges having read before concluding an Order.
The client declares to be of legal age and to have full legal capacity, allowing him to commit to the GCS or to act under the supervision and with the agreement of a person having parental authority in the title reserves the right to modify at all moment the GCS.
However, only the GCS accepted by the Customer at the time of the conclusion of the said Order will be applicable to an Order.
Article 3. Definitions
The terms capitalized in the GCS will have the meaning defined below:
“Customer”: any person who has placed an Order on the Site.
“Order (s) (ing)”: the contract concluded electronically on the Site, binding the Customer and Anticipolis for any sale via the Site of Products offered for sale on the Site.
“License of Use”: terms of use for ebooks containing the rights and obligations of the Customer Ordering an ebook and including information relating to MTPs.
“ebook”: electronic file representing a work of the mind as defined in article 1 of Law n ° 2011-590 of May 26, 2011 as well as the dematerialized form of a paper book.
“MTP”: Technical protection measures imposed by the publishers and / or distributor of ebooks and intended to protect them from the use of ebooks not authorized by the User License.
“Products”: all the goods offered for sale on the Site and which the Customer can order from Anticipolis, in particular paper books, stationery and ebooks.
Territory: delivery zone for Products Ordered via the Site, corresponding to:
For Products other than ebooks: worldwide unless otherwise applicable when ordering.
For ebooks: Territory (s) authorized by the publishers, as specified on each ebook description page.
“User”: any person browsing the Site without placing an Order.
Article 4. Formation of the contract and orders
4.1. Prices
The selling prices of the Products, indicated in euros, are those in force at the time of validation of his Order by the Customer.
They do not include the costs of managing the Order and shipping the Products, invoiced where applicable in addition to the price of the Products, depending on the amount and composition of the Order. Any applicable management and shipping costs are indicated to the Customer before the Order is concluded.
The prices include the value added tax (VAT) applicable on the day of the Order. Any change in the applicable VAT rate will automatically be reflected in the price of the Products offered for sale on the Site.
The selling prices of the Products can be modified by Anticipolis and / or the publishers of the books at any time. The prices applicable to an Order are those indicated to the Customer in the summary preceding the conclusion of the Order by the Customer.
In accordance with the law n ° 2014-779 of July 8, 2014 modifying article 1 of the law n ° 71-766 of August 10, 1981 relating to the price of the book, the orders of books sent to the buyer and which are not collected in a book retail business, the selling price of the book is that set by the publisher or importer and delivery of this book may not be free.
4.2. Product Features
In accordance with Article L. 111-1 of the Consumer Code, the Customer may, prior to any Order, find out on the Site of the essential characteristics of the Product (s).
The Customer selects one or more Products from the different categories offered on the Site.
The Products offered for sale on the Site may be Ordered within the limits of available stocks as established by Anticipolis several times a day. In the event that an Ordered Product is temporarily or permanently out of stock, Anticipolis customer service will contact the Customer as soon as possible to warn him that his Order may not be honored within the time limits indicated or may be canceled. Where applicable, Anticipolis would also inform Users as soon as possible via the Site. If there is no stock for a given reference, Anticipolis will order the work from the publisher concerned. These deadlines are between 4 days and 8 weeks.
